Florida Citizens Protest to Governor Crist on Highway Safety, Tower Compliance, and Tow Truck Co. Standards

Dear Governor Crist,

Warm summer greetings from Orlando’s city beautiful.

First I want to thank you for your outstanding and heartfelt service to our State and its people.

As you know Senator Victor D. Crist has been tirelessly working for years to reform legislation and toughen tower regulations before local law enforcement discard Florida citizens’ automobiles to unscrupulous towers.

I urge you to give the utmost attention to this matter considering the safety and personal property of the people of Florida are at stake.

Please allow me to document a dreadful incident I experienced after I was hit by a repeat offending drunk driver in Volusia County at 4:40pm on July 8, 2008. Following a near deadly accident in which I was hit repeatedly by an out of control drunk driver who never thought to apply her brakes until she hit me and thereafter drove off the highway to hit another car parked at a restaurant, my car ended up in the restaurant drive way.

Deland Police Officer Quinn did an excellent job attending to the accident and filing the crash report 09675822. Another officer working for Deland’s law enforcement however was very pushy and impatient with me when informing me that my car would have to be towed by reason of State law, which I was told required all vehicles be removed within 30 minutes.

I had every intention of removing the vehicle and bringing it back to my home in Orlando, but first needed to attend a brief interview for a Masters degree program in Mental Health Counseling at Stetson University two blocks down the road. Nevertheless the unknown officer was so overbearing I had no choice, but to comply after which the police assigned tow truck “Johnny’s Auto Body” arrived to remove my car.

When I phoned Johnny’s Auto Body (230 S Industrial Dr. Orange City, FL 32763) on the morning of July 9th to inquire as to the itemized charges, they were very unprofessional and rude to me. When I arrived at 9:00am on July 11th to pick up my car from the storage yard, the following series of events transpired.

My car was kept at Johnny’s Auto Shop for 3 days, but they charged me for 4 days. Johnny’s receptionist and owner refused to show me an itemization of charges and demanded I pay in cash beforehand.

Hence I could not see what I was paying for and was made to pay for highly questionable charges and fees that I knew nothing about before I could see an itemized invoice. When I looked at my car before the AAA tow truck arrived, Johnny’s refused to allow me to take any of my personal items (like breath mints) out of my car.

As our relations immediately reached an impasse, the secretary and owner barking out orders behind the desk refused to give me their names when I asked. Beyond lacking professionalism, they were quite rude and condescending.

I felt like I was being treated like a criminal just released from jail on bond, but I was nothing of the sort as I had been hit by a drunk driver and just wanted to retrieve my car.

After paying $331.52, Johnny refused to allow me and my mechanic next door into Johnny’s storage yard (which is marked “not responsible for vehicles or contents”). Johnny wanted $55 to move my car 20 yards on to the street so my mechanic could make a free estimate for repairs. Johnny himself offered me an estimate for $25 for repairs, which I refused. Furthermore, Johnny’s refused to allow me to park my rental car in his massive empty parking lot, neither did the company allow me to wait in their lush AC showroom while AAA took 2 hours to come.

So after enduring being hit by a drunk driver and sustaining back and neck injuries, I had to wait outdoors in the hot sun to retrieve my vehicle from a tow company I in advance paid in full and was afterward treated by the company like a criminal.

Johnny’s has big jugs of water from Crystal Springs but wouldn’t give me a cup to have a drink when I was thirsty. Johnny’s wanted to charge me $25 to use his bathroom.

When I finally received a somewhat itemized invoice for charges amounting to $331.52, the invoice was not legible as the ink was extremely faded. I kindly asked for another darker and more legible copy, but was told by the secretary that they were out of ink. I than asked for a copy to be mailed me once they purchased ink for their printer. Johnny immediately offered to mail me a legible copy for a fee of $25.

Upon walking around a bit and talking to Johnny’s neighbors, I also discovered Johnny is disliked by some businessmen on his street. Auto Work next door told me, “Johnny’s Auto Body is unprofessional in their approach. He treats people unfair and his neighboring businesses.”

Auto Works are some very nice guys next to Johnny’s Auto Shop. Auto Works told me that Johnny called the police on a woman who’s battery died in front of his shop to have her arrested and her car removed.

Upon examining State records, I noticed numerous citations against Johnny’s  and owner John Brucato which are cause for safety concerns. This being said, as a matter of public safety I must ask:

1. What professional standards does the Statewide Traffic Incident Management Team adhere to when adding towers and tow truck companies to law enforcement’s roster to render services to the general public?

2. Does the State of Florida not regulate towing companies responding to law enforcement requests for service? And if not, should not local law enforcement and the State of Florida be jointly liable for referring such faulty and fraudulent companies to the general public?

3. Is not the quality of towers being given business in response to law enforcement needs a matter of legitimate concern to the State of Florida? And if not, are not transportation systems across the State being grossly jeopardized?

4. Are there no proper site management practices to which towers should be made to adhere when working on behalf of law enforcement across the State of Florida?

5. To what extent is the State of Florida and its respective countries properly training towers and tow truck responders?

6. Is not the State of Florida, its counties, and cities liable for the negative impact of improper tow procedures if it willfully neglects the above mentioned?

7. Should there not be some mutually agreed and acceptable safety and business practices for all towers responding to calls from law enforcement?

8. What procedures are currently being discussed and implemented to reduce the number of emergency vehicle crashes across the State of Florida?

9. When a tower has a record of traffic violations should he be licensed and referred business from law enforcement in the State of Florida? Should this industry be no less regulated than the Department of Education that will not hire a teacher with a criminal record?

10. When more deaths and injuries occur on our highways daily than anywhere else, what can be said for a State that carelessly neglects to attend to these matters?

11. Is the State of Florida currently complying with the Federal Highway Administration guidelines? To what extent are towers and tow companies being made to comply with National ITS Standards?

12.  How is towing dispatched by law enforcement regulated and contracted for across the State of Florida? What minimal qualifications are required of towers before law enforcement dispatches business to these towing companies?

13. How committed are you to establish a team that meets on a regular basis to evaluate and improve coordinated incident responses to law enforcement and to address these above mentioned problems?

14. Are towers in the State of Florida required to be certified under the Towing and Recovery Association of America’s National Driver Certification Program?
Governor Crist, I respectfully urge you to strategically plan and quickly attend to the matter of towers conspiring to defraud the general public and breaching their fiduciary duty to law enforcement and Florida’s citizens.

Such safety violations and unfair business practices as mentioned above will no longer be tolerated by the people of Florida.

Beware of doing business with Johnny’s Towing and Autobody Inc. in Orange City, Florida. They have some highly questionable business practices, which many may deem bad and unethical. They also lack professionalism pertaining to standard and customary business practices.

I had my Honda taken from me in Deland on July 8, 2008 by the police against my will after I was hit by a drunk driver who was taken to jail. My car was kept at Johnny’s Auto Shop for 3 days, but they charged me for 4 days when I arrived at 9am to pick up the car on the morning of July 11th. Johnny’s refused to show me an itemization of charges and demanded cash before they would give me an itemized invoice and my car. Surprisingly, Johnny wouldn’t let me take any of my personal items (like breath mints) out of my car. Johnny and his secretary were too ashamed to give me their names when I asked and were quite rude, evasive, and secretive. It kind of gave me the feeling that they knew they were up to no good and were always trying to cover their tracks.

They refused my minister’s tax exemption with the state of Florida. After paying $331.52, Johnny refused to allow me and my mechanic next door into his storage yard (which is marked “not responsible for vehicles or contents”). Auto Works next door told me Johnny complains about the grass when they mow it and any cut grass gets blown over into his side. 

Ramirez Auto, a stone’s throw from Johnny’s shop, told me this about Johnny:

“Since we changed locations to the new workshop, he treats us like Hispanic idiots just because we’re unable to understand or speak the English language. We have enough education to say, ‘Good Morning’ and believe in the sincerity of people. We feel very badly when they do not answer us and look at us badly us treating us like Hispanic idiots.”

I found other safety concerns about Johnny online, given traffic violation citations I saw documented at the Volusia County website against him and his company.  

I encourage you to add your complaints here as well and most importantly with the Better Business Bureau.

Were told by DeLand P.D. to release car. Said they would call me on Sat. Never did. I called 20x and was told they will not open till Mon. And will add money because I “aggravated them”. I will be suing in civil court. They were also not on they Counties rotation to tow vehicles. I lost 2 days of work and they charged me 2 extra days of storage.

AAA Plus Lies, Deceit, Breach of Contract, and Unfair Billing Practices

I have been a AAA member since 1987 when I began driving. My grandfather U.S. Army Lt. Colonel Paul Krofchik had me on his account until I got my own AAA account on August 15, 2001.

I upgraded to AAA Plus on July 7, 2008 and when I was hit by a drunk driver who destroyed my car and nearly killed me on July 8, 2008 in Deland, FL I immediately called AAA for roadside assistance. They told me they could not be out to the site until two hours later, maybe an hour an a half at best. Deland policed removed my car against my will and towed it to an auto body shop.

When I called AAA the next day to come pick up my car, they refused to honor my newly purchased AAA Plus account telling me I must wait 3 days for it to be approved.  Meanwhile I had to pay an extra $25 a day while my car waited at the salvage yard to be picked up.

Ironically, after I called today to get the roadside assistance (that after a 3 day wait) I was told my father-in-law’s credit card had to be re-authorized.  After going through that grueling process with two AAA reps, my call was forwarded to what was to be a supervising dispatcher to get me a tow truck to transport my car from Orange City to Orlando.

As if I had not gone through enough hell already getting me to the membership rep 7044 Aurora Marinta who wonderfully took care of the membership issue telling me I did not need to pay any more and that the other rep was incorrect….then I got Mr. Gene Ford who asked me the same questions before processing my Friday morning July 11th, 10am appointment to tow my car.  Gene after digging deeper in his trusty computer realized Aurora had already dealt with and handle the matter of concern and proceeded to book me a tow truck for 10am Friday morning.

Then after all that aggravation, 5 minutes later I received a phone call from Heathrow, FL rep Faye Morgan who informed me the appointment would not stand because AAA only makes appointments on Tuesday thru Thursday, not on busy days such as Friday. Hence my long awaited appointment for a tow truck was canceled.

What is the moral of the story? Use another company other than AAA because their employees are not communicating properly nor accurately with one another. The consumer is being falsely promised services, contracts are being breached, services withheld, and lies with deception being fed the consumer.

The fact I am in pain physically and stress emotionally after being nearly killed by a drunk driver does not matter. As Mr. Ford said he has to first confirm my membership is current. As I told him it’s all about money, not serving people.

Unless you like such a gruelling experience, I advise you to look elsewhere than AAA.  I was to have service for both me and my wife, after 2 days of hell signing up.  Than on the 3rd day when I attempted to use their service, they raised their fees suddenly and now want to charge me another $28 to get my wife on the policy.

AAA stinks and your complaints should promptly be filed at the Better Business Bureau immediately.

USAA’s appeal against R. Brent O’Neel was denied by the in the COURT OF APPEALS OF THE STATE OF NEW MEXICO on March 1, 2002, No. 27,334.

{1} Defendant (USAA) appeals the judgment entered in favor of Plaintiff (O’Neel) awarding damages and attorney fees for bad faith failure to pay a first party claim, breach of an insurance contract, and unfair insurance practices.

(2) Following the burglary of a house he was building near Tome, New Mexico, O’Neel submitted a claim under his USAA renter’s insurance policy. Under the terms of the policy, O’Neel was entitled to the replacement cost for personal property stolen in the burglary. Consequently, O’Neel submitted a claim to USAA requesting reimbursement in the amount $7052. USAA began an extensive investigation into O’Neel’s claim, which included two lengthy examinations of O’Neel under oath by USAA’s attorney. Based on its investigation and evaluation of O’Neel’s claim, USAA concluded that O’Neel overvalued the amount of his claim. Because of these ostensible overvaluations, USAA accused O’Neel of breaching the insurance contract by misrepresenting and concealing material facts and by failing to cooperate with the investigation. As a result, USAA denied O’Neel’s claim in its entirety. (3) Upon receiving notice that USAA denied his claim, O’Neel instituted this action to recover damages for bad faith breach of an insurance contract and unfair insurance claims practices. The district court referred the action to court-annexed arbitration, and the arbitrator’s award in favor of USAA was ultimately appealed de novo to district court. A jury trial was held at which both sides presented evidence concerning the extent to which Plaintiff did or did not overvalue his claim and cooperate with USAA’s investigation. Both sides also presented evidence from experts in the field of insurance claims practices to give their opinions on the reasonableness of USAA’s claims handling practices. Although O’Neel valued his claim at over $7000, the jury awarded O’Neel only $2500 in compensatory damages. However, the jury also found that USAA breached the insurance contract in bad faith and engaged in unfair insurance practices. The jury, therefore, awarded O’Neel an additional $20,000 in punitive damages. In addition, the district court subsequently awarded O’Neel over $64,000 in attorney fees.

I was hit by a drunk driver yesterday (who is now in jail) and my car was totaled. But by the grace of God, I should be dead now due to the horrific impact and the size of the truck that hit me.

I’m now battling USAA for a new car and medical bills, etc. as I had maximum coverage afforded me.

Does anyone have any advice on how to successfully and speedily get from USAA what they rightfully owe me and I paid for annually for several years in generous insurance premiums?

I noticed that a Mississippi couple – Admiral James Lisanby and his wife Gladys have sued USAA for $910,000, pursuing punitive damages for USAA’s neglect and resistance to pay them what they are rightfully due for the Katrina tornado that tragically took so many people’s homes. This apparently is the 1st Hurricane Katrina insurance lawsuit to go to trial (June 16, 2008).

David and Marilyn Aiken (Gulfport, Mississippi) filed a lawsuit against USAA on January 18, 2008 for conspiring to defraud them full payment of their $680,000 homeowner-insurance policy with USAA.

As for me, can anyone advise me what I can do? I am a minister with a nonprofit organization.

Ironically, they who claim to enforce the law are themselves violating the highest supreme law of the land. The first amendment of the U.S. Constitution permits freedom of speech and equal access to intellectual property, which dissemination of Lake County Corrections blatantly hinders and denies its inmates.

Worldwide minister & author Paul Davis personal letters to an inmate at Lake County Corrections (Tavares, FL) were repeatedly denied, labeled illegal, and censored. When Davis phoned to speak to Ms. Williams within the mail room, Williams advised Davis to send the letter addressed to her and white out the website below the poem Davis an author had personally written. Williams assured Davis once the website below was removed, the correspondence would go through to the inmate.

The initial letter was returned and on the exterior of the envelop was written “illegal contraband”. Davis who worked on Ground Zero the first week of 9/11 found this a bit amusing, considering all he had sent to the inmate was a poem he had written about Albert Einstein. “I guess that was too much intellectual stimulation for the corrections officers and inmates.” Davis laughingly said.

However upon the third attempt to send letters previously denied, Davis to his surprise after following Ms. Williams protocol received the bundle of previous denied letters that he had whited out the websites below and attempted to send again. This time the denial was marked “Not allowed due to content.”

It seems Lake County Corrections does not only refuse mail, it also now censors it.

Upon phoning Ms. Williams boss officer Kenneth Zimmerman, Davis asked him for the written criteria for what mail is refused. Zimmerman replied, “Well, that’s always changing.”

Davis responded, “How convenient for you. Well sir, please send me the list of the last documented publication requirements and stipulations as to what criteria and categories of mail are to be denied so I can comply.”

Zimmerman contradicted his subordinate Williams telling Davis poems were to be excluded altogether. When Davis told Zimmerman he was an author and wrote the material himself along with 14 books, Zimmerman told Davis to mail the books through a bookstore.

David responded, “I’m not endeavoring to mail a book. I am simply trying to send a poem which I personally wrote and typed.”

Zimmerman spilled the beans saying, “Well anything that looks like a download we reject. It has to be hand written.”

It seems they in the mail room at Lake County Corrections lazily reject mail before adequately and thoroughly looking through its contents. Obviously the tendency is to lazily deny rather than approve. This was a direct contradiction to what Williams told author Davis a week ago that typed poems and letters were permissible.

Yet whatever ‘hot water’ the mail room staff thinks they are staying out of by haphazardly denying legitimate mail will soon backfire on them when Constitutional attorneys take this to the Supreme Court.

Davis who completed a year of law school himself in New York said, “It seems the ‘good old boys’ down there at Lake County Corrections just do about whatever they want despite the Constitutional perimeters and the statutes within the supreme law of the land governing us all.”

I received an email dated June 5, 2008 from Robin Bourn that said:

“My son is in Lake County Corrections currently awaiting a parole violation hearing. He was five days from being released from parole and Florida violated him due to a DUI in Arizona, which is where he has lived since his release from Florida a year ago.  I believe his rights are being violated, as they have put him in  solitary confinement for having a candy bar belonging to another inmate (this is what I was told on the phone).  He is not allowed to receive mail while in solitary.  Is this a violation of his rights and is there anything I can do? I live in Indiana and am extremely concerned about what I’m being told about the conditions he is being kept in.  I don’t know what to do and the lady on the phone at the prison was very rude and no help. Thank you for any advice or help you can give.”

Burma’s Aung San Suu Kyi conferred honorary Canadian citizenship while under house arrest in Myanmar

Burma’s pro-democracy icon and Noble Peace Laureate Aung San Suu Kyi, who is under house arrest, will be conferred an honorary citizenship by the government of Canada.

I think it’s so cool Burma’s human rights advocate and Nobel Peace Laureate who has struggled selflessly for years for the liberation of her people, will be honored in such a way.

My wife is Canadian and I think that’s a first class move of solidarity with Aung San Suu Kyi and the people of Burma.

I’ve been to Burma several times ministering in various churches covertly and was disgusted with the level of governmental corruption I experienced. From the time you go through customs and cross the border, the greedy government is in your pocket making you exchange $300 USD in exchange for the FEC (federal worthless currency), which even the locals don’t want. Then to be of any value in Burma you must exchange the FECs for chat (the local currency), which you lose about 7% value upon immedite exchange. So basically the government beyond the visa immigration fees, wants another $21 upon arrival per person for themselves.

What makes my blood boil is the way you can’t travel freely throughout Burma. Nevertheless I went to several black out zones to preach the Good News of Christ to former University students (who couldn’t attend University for a while because the ignorant and fearful government had for some time shut the Universities down in an effort to practice mind control and a futile attempt to rid the land of democratic ideals from the West).

Laugh out loud at such governmental stupidity! Now the monks and people throughout Burma are rising up and boldly challenging the military junta – some even dying for their battle for freedom. The recent cyclone that devastated the country showed the heart of the governmental junta who withheld foreign assistance and aid for weeks, fearing they’d lose control over the people.

I pray God Almighty breaks the back of the enemy and causes the evil to bow before the good in Burma and be brought to justice swiftly before international tribunals for crimes against humanity. I pray corrupt governmental officials in China backing this brutal regime in Burma also be brought to justice.
